Appeal Court Victory: Adeleke Says Tribunal Judgement, Miscarriage Of Justice

The Governor of Osun, Senator Ademola Adeleke has described the judgement of the State Election Petition Tribunal as miscarriage of justice. 

This is coming on the heels of his victory on Friday, as the Court of Appeal sitting in Abuja restored him as the winner of the July 16, 2022 governorship election in the state. 

The Osun Governorship Election Petition Tribunal had in January 2023, insisted that Oyetola of the All Progressives Congress (APC) was able to prove that there was over-voting in some of the polling units.

But in a statement made available to journalists on Friday in Osogbo, Adeleke dedicated his victory to God and the people of Osun state. 

He noted that with the appeal court judgement, the judiciary had right the wrongs of the tribunal, adding that it rekindled  his confidence in the integrity of the judiciary as last hope of the common man.

“I am particularly glad that the Court of Appeal has ruled that Bimodal Voter Authentication System (BVAS) machine and voters register are the primary sources, not the report from the server.

”This has strengthened our democracy and removed a time bomb which the judgement of the Tribunal had planted for our democracy.

”I appreciate Osun people for standing by me and my party through repeated validation of my governorship mandate at the recent general  elections," he added, 

Adeleke pointed out that his party, the PDP won three straight elections from July 16, 2022, to March 18, 2023, saying that the judiciary has further confirmed the will of the people that he was duly elected governor of his state.

While commending the judiciary for resisting all pressure, he noted that the rule of law is strengthened when judgement affirms the will of the people.

He appreciated the PDP, civil servants, artisans, market people, clerics, students, women and youths for defending the mandate from 2022 till date.

Adeleke extended his hands of fellowship to former Governor Oyetola and the APC, pleading with them and all political class to join forces with his government and build the state. 

He noted that Osun needs leaders across party lines to collaborate for robust and accelerated development, adding that there is a need to commence the process of healing.

BOblog reports that the Court of Appeal sitting in Abuja had on Friday set aside the tribunal verdict that nullified the election of Adeleke as governor of Osun State.

A three-member panel of Justices led by Justice Mohammed Shuaibu, held that the Tribunal erred when it ruled that Oyetola and the APC proved their allegation of over-voting in the July 2022 election.
